Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on January 14. 1997
this Executive Session was called to consider a Litigation matter.

LITIGATION
The Village Manager noted that Walgreens must vacate by January 31, under
the agreed order. They are protesting that date and seeking a February 18 date.
The Village Manager and Village Attorney presented, subject to Village
Board concurrence, possible settlement to keep Walgreens in the location through
redevelopment. The agreed order would need to be amended, eliminating the
$325,000 payment by the Village to Walgreens and in return the Village would
consider:
1. Walgreens can stay in the store on a temporary basis but they pay for the cost of
utilities; maintaining the parking lot; plowing and supply parking lot lighting,
2. Elk Grove does not provide $325,000 payment but will :
• forgo $3,708 in monthly rent
• forgo $6,800 in agreed-order monthly reduction on $325,000
• forgo % of sales rental income
• fund$12,000 in added demolition costs; and,
Elk Grove pays property taxes and insurance. The total value savings to the Village
is estimated at $172,000.
The consensus of the Committee was to concur with the Village Manager's
proposal.
