Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on 08/10/99 this
Executive Session was called to consider a Litigation matter.

LITIGATION
The Board discussed delays in the construction of the Oakton Street Fire Station. The
Village Attorney previously reviewed the issue and recommended against litigation.
The Village Manager reported that a number of steps are being taken to ensure the project
is done on time:
• withholding payment until a substantial amount of work is done;
• weekly status reports from the Fire Chief to the Village Manager for distribution
to the Village Board;
• The construction management fine, Blank, Wesselink& Cook (BWC) will meet
daily with the trades to coordinate the work; and
• The Fire Department will keep a daily log of workers on-site, number of
deliveries, and other relevant information.
It was also noted that the presidents of the general contracting firms and BWC will give
their personal attention to this project until it's completion. The deadline for completion
was agreed to be October 1, 1999.
The consensus of the Board was as follows:
• to direct staff to provide the Board with copies of inspection reports; and
• to direct staff to obtain a schedule and timetable of remaining work to be done.
