KNICKERBOCKER Village Trustee Village Attorney Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on 06/27/2000 this Executive Session was called to consider a Litigation matter. Number of pages attached: 1 Date(s) of review for release: January 2001 Date of approval for release: RECEIVED AUG 16 2000 VILLAGE CLERK'S OFFICE 6/27/2000 9:15 p.m. LITIGATION The Village Manager provided the Board with information about two pending lawsuits against the Village. Firefighter Carla Penn has filed a complaint against the Village to the Department of Human Rights for discrimination. Her complaint is based on her claim that disciplinary action taken with her was stronger than what white male employees received for similar actions. The Manager explained that Penn was disciplined for several issues: she lost her way in responding to a call, didn't follow her partner's address directions on several occasions, and had two accidents while driving apparatus, all within several months. The Department of Human Rights has decided she has sufficient evidence to pursue legal recourse, which will now entail mediation. Retired Fire Lieutenant Bernie Goss has filed a lawsuit against the Village for age discrimination. The Manager explained this suit is based on Mr. Goss' contention that the decision to have EMS responsibilities transferred to another officer was based on age. The Department of Human Rights has decided this suit has no merit. Mr. Goss suffered no loss in pay resulting from this decision since he was on one of the several non- compensated committees within the Department. Defending the lawsuit will cost the Village a minimum of$25,000 and perhaps upward to $50,000 for the motions portion of the suit. The consensus of the Board was to defend the suit, rather than reach a compromise settlement. Meeting adjourned 9:30 p.m. lk
