Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on 1/26/93, this Executive Session was called to consider
a litigation matter.

The Village Attorney discussed a Freedom of Information Act
(FOIA) request from a local media source. The request asks for
information that is not under the auspices of the Act, including
the private notes and memoranda of the Police Department. It is
the opinion of the Village Attorney that if the request is denied
the Village would be subject to imminent litigation on the
issue. The Village should seek to protect its right to not
disclose the private information of the Police Department.
Upon advise of counsel, the consensus of the Board was to
only release documents of public record filed with the Circuit
Court. No other information is to be released.
