Pursuant to a duly made and approved motion and a majority vote at a
regularly scheduled meeting of the Village President and Board of Trustees
on February 23, 1993 this Executive Session was called to consider a
Litigation matter.

LITIGATION
The Village Board discussed the possible condemnation of
property at the Grove Mall.
The Village Attorney noted that municipal governments can
condemn property for eminent domain purposes, but the property
must be used for a public purpose. The Attorney also noted that
buildings may be condemned if they become a public nuisance, in
which case the Village would have to prove the buildings are a
nuisance in Court and petition to have them demolished.
The consensus of the Board was to not seek the condemnation
of any property at the Grove Mall. Village Staff is to work to
put the owner of the Grove Mall in contact with a commercial
developer to discuss the redevelopment of the site.
The meeting adjourned at 7 :53 p.m.
