Pursuant to a duly made and approved motion and a majority vote at a
regularly scheduled meeting of the Village President and Board of Trustees on
April 13, 1993,this Executive Session was called to consider a litigation
matter.

LITIGATION
The Village Manager reported that the Village Attorney
provided a written response to the Attorney representing "We the
People" on the Kmart development at the northwest corner of
Meacham and Biesterfield. The response upholds the legality of
Village procedures approving the Super Kmart development .
Kmart has offered to fund 50% of the Village 's legal fees in
this matter.
The consensus of the Committee was to have the Village bill
Kmart for the expense of any legal advice given to Kmart by the
Village Attorney. The Village will fully fund any legal expenses
incurred in the defense of the Village.
