Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on September 14, 1993, this Executive Session was called
to consider a litigation matter.

LITIGATION
The Village President reported that a September 20 meeting is
scheduled with the owner of the Grove Mall to confirm that a
developer has been retained to redevelop the Grove Mall. If the
owner has a developer, the Village will begin action to terminate
the Jewel Lease.
The Village Attorney explained the process involved in
condemning the Jewel lease. The first step in the process is to
have an appraiser determine the value of the Jewel lease. The
second step would be to make an offer to Jewel based upon the
value of the lease. At this point a statement of purpose would
need to be prepared detailing the exact losses and hardship the
lease is causing the Village and owner of the development . The
last step would be the adoption of an enabling ordinance to
condemn the lease.
It was noted that Jewel has advertised for a subleasee of the
Jewel space.
The consensus of the Board was to have the Village Attorney
research the feasibility of pursuing the condemnation of the
property and the lease-hold interest of Jewel .
