Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on October 12, 1993, this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village Manager reported of a telephone conversation he
had with a Jewel executive regarding the Jewel lease at the Grove
Mall . The Village Manager noted that because of the lawsuit
between Serfecz and Jewel over this matter, Jewel is hesitant to
meet with the Village. The Jewel executive mentioned that Jewel
attempted to negotiate the release of the lease with Serfecz and
claims that the real issue is the amount of compensation for the
lease.
The consensus of the Board was to adopt an ordinance which
will give the Village the ability to declare the Grove Mall and
any other property as a blighted area, at the October 12 Village
Board meeting. In addition, the Village will be retaining the
services of two appraisers to determine the value of the Jewel
lease should the Village proceed with condemnation litigation.
