Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on January 11, 1994 this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village Attorney stated that Joe Serfecz and Jewel are still
unable to resolve the leasehold interest and settlement on the
anti-trust lawsuit .
The Village Attorney stated that the Village can conduct a public
hearing to determine if the Grove Shopping Center is a blight
area . Therefore, consideration can be given to proceeding with
condemnation litigation.
The consensus of the Board was to establish a public hearing date
of February 15 at 8 p.m. if possible.
In addition the Board directed the Village Attorney to determine
if certain Board members have a conflict of interest in voting on
this issue.
The meeting adjourned at 9 :44 p.m.
