Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on January 25, 1994, this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village Attorney commented on the litigation strategy for the
public hearing on February 15 to consider designating the Grove
Mall a blight area.
The Village Attorney stated that public notice of the hearing
must be given prior to February 5. This includes notification to
the Grove Mall owner, its tenants and newspapers. A second
notice will be given prior to the public hearing.
The Village consultant will be at the hearing to provide evidence
that the Grove Mall meets the criteria of a blighted area . A
copy of the consultant 's report will be given to the Board prior
to the public hearing.
Approximately 14 to 90 days after the hearing the Village Board
if appropriate, can adopt an ordinance determining the area as
blighted. At this time the Board could discuss strategy on the
redevelopment of the center.
The Village Attorney noted that Trustee Chernick may need to
abstain from voting on this issue due to a conflict of interest .
