Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on February 8, 1994, this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village Attorney reported on discussions between Jewel
and the Village regarding the acquisition of their lease at the
Grove Mall .
It appears that Jewel is willing to settle the issue prior to
the Village entering into condemnation litigation. Jewel is
attempting to establish a present value of their lease at
$250,000 based upon an offer from an antique store to sub-lease
the space. The Village Attorney will continue discussing this
item with Jewel .
In addition, the Village Attorney advised that leases of
other facilities in the Grove Mall may need to be acquired by the
Village.
The consensus of the Committee was as follows:
1 . Offer Jewel up to $50,000 for the lease;
2. Try to determine what other leases may need to be
acquired through condemnation, litigation or a
settlement.
The meeting adjourned at 9:45 p.m.
