Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on March 22, 1994 this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village President informed the Board that a decision on a
motion for summary judgement is expected near the end of April on
the anti-trust lawsuit between Serfecz and Jewel . In addition,
if Jewel and Serfecz do not resolve the issue of the Jewel lease
by the end of April, Jewel has agreed, in principle, to turn the
lease over to the Village for $50,000, negating the need for the
Village to pursue condemnation litigation against Jewel . The
Village Attorney is reviewing other tenant leases in the Grove
Mall for possible condemnation litigation.
