Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on May 24, 1994 this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village Attorney updated the Board on the preparation for
condemnation litigation against Jewel .
It was the consensus of the Board to proceed with the
attached timetable towards condemnation of both the entire Grove
Mall, without the Jewel lease, and the Jewel lease. It was
further noted that at the May 24, 1994 Board Meeting the
ordinance extending the time period for the Board to designate
blight areas from 90 to 180 days will be adopted. Finally, this
timetable would still not have to be strictly adhered to
dependent upon the future proceedings to settle the lease issue
between Jewel and Grove Mall . This timetable will be made known
to Jewel and Grove Mall .
The village President distributed the attached press release
and timetable on this matter.
The meeting adjourned at 7:10 p.m.

B. Adopt ordinance extending time period for Board to de-
signate any area as a blighted area from 14 to 90 days
to 14 to 180 days.
II. June 14 , 1994
A. Adopt an Ordinance designating the Grove Mall Shopping
Center as a blighted area.
B. Authorize the Village Attorney to acquire a preliminary
appraisal with respect to the value of the Shopping cen-
ter in its entirety and the Jewel leasehold interest.
III . June 28, 1994
A. Adopt an Ordinance authorizing the Village Attorney to
negotiate and acquire the Grove Mall Shopping Center.
B. Adopt an ordinance authorizing the Village Attorney to
negotiate and acquire Jewel' s leasehold interest in the
Grove Mall Shopping Center property.
Iv. July 1, 1994 through July 31, 1994 - Village Attorney to
acquire final appraisal from consultant and prepare offer
sheet and submit offer to purchase the Grove Mall Shopping
Center and the Jewel leasehold interest.
V. August 1, 1994 through September 13, 1994 - Negotiation by
Village Attorney with Shopping Center owner and Jewel and
the determination by the Attorney of the viability of a ne-
gotiated private sale versus a legal condemnation proceeding.
VI. September 13, 1994
A. Private sale acquisition - authorize the Village Attorney
to acquire the subject property based upon the negotiated
sale price; or
B. Authorize the Village Attorney to commence condemnation
proceedings.

PRESS RELEASE
May 24, 1994
On May 24, 1994 the President and Board of Trustees of the
Village of Elk Grove Village set into motion the declaration and
designation of the entire Grove Mall Shopping Center as a blighted
area. The Village Board also set into motion the negotiation and
acquisition of the entire Shopping Center and the negotiation and
acquisition of the leasehold interest of the vacant Jewel store
located in the Center. It is anticipated that Ordinances trigger-
ing these actions will be acted upon in a series of Board meetings
beginning on June 14, 1994.
In taking the above actions, the Village has clearly reaf-
firmed its commitment to revitalize the Grove Mall Shopping Cen-
ter. Village President Dennis Gallitano summarized the Village' s
position by stating, "The Village has waited long enough for Grove
Mall and Jewel to resolve their differences amicably. The Village
cannot continue to sit idly by while a blight condition exists.
It is time for the Village to step forward in a positive and ex-
peditious manner in order to safeguard the economic viability of
the Village and cure the economic blight occasioned by the legal
entanglement of private parties. "
