Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on August 9, 1994 this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village President reported that Grove Mall contacted
the Village Attorney with a proposal to set the amount of
damages they would request of Jewel due to Jewel not
relinquishing the lease. In turn, the Village would present
that figure to Jewel for consideration in exchange for the
lease. The antitrust lawsuit would then be able to proceed
and not effect the release of the lease.
In response to this proposal the Village requested that
Grove Mall provide justification supporting the damages amount
prior to approaching Jewel . Grove Mall has not responded to
this request. In addition, Grove Mall has requested to meet
with the Board on this issue.
The consensus of the Board was to have the Village
Attorney contact Grove Mall and require them to provide a
response to our request before scheduling a meeting with the
Board.
