Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on May 9, 1995 this Executive Session was called to
consider a litigation matter.

LITIGATION
Grove Mall
The Village Attorney brought the Village Board up-to-date
on the issue.
The sides are discussing a settlement. Serfecz started
at $7.5 million which was $1 million above their appraiser's
value. Now, their offer is down to $6,375,000 for the
property, excluding Burger King. The Village Attorney was
previously authorized to offer up to $6 million for the same
portion of the property.
Full litigation will cost about $150,000. It may be
prudent to hire an appraiser to settle the issue between the
two parties ' current offers. That issue will be explored
further.
Our offer is subject to a Phase I environmental study.
The attorney is negotiating the Phase I contract to place
liability for omissions on the contractor. The cost will be
about $3,500 for this service.
The consensus of the Board was as follows:
1 . Negotiate the Phase I environmental contract; .
2. Offer up to $6 million for the property;
3. Draft an RFP by May 31 to market the property to a
developer upon purchase; and
4 . Pursue all outstanding maintenance violations --
provide no special treatment.
The meeting adjourned at 11 :30 p.m.
