Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on May 23, 1995 this Executive Session was called to
consider a litigation matter.

LITIGATION
Grove Mall Condemnation
The Village Attorney brought the Village Board up-to-date
on the litigation surrounding the Grove Mall condemnation.
The attorney stated that the owner of the Grove Mall had
agreed to lower his offer from $6.5 million to
$6.375 million, which was still $.375 million higher than what
the Village had authorized for the property.
The Village Attorney advised the Village Board that he
offered a settlement window of $5. 8 to 6.2 million in order
for both parties to reach a settlement. This would be
accomplished by having the two real estate appraisers from
both sides select a third appraiser who would establish the
market value of the property within the agreed upon window.
The Village Attorney also advised that: The Village is
pursuing the commercial maintenance code violations; that
Special Counsel Ryan has filed a motion to compel discovery;
and, that the draft RFP will be completed by May 31 .
The consensus of the Committee was for Special Counsel
Ryan to update the Village Board on the status of the
litigation.
The meeting adjourned at 9:29 p.m.
