Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on June 13, 1995 this Executive Session was called to
consider a Litigation matter.

LITIGATION
The Village Attorney brought the Village Board up to date
on the status of negotiations to condemn and purchase the
Grove Mall . The Village Attorney stated that Grove Mall
ownership may agree to a settlement in the neighborhood of
$6. 1 million.
The consensus of the Village Board was as follows:
1 . Offer up to $6. 1 million for the property,
excluding Burger King and have it entered as an
agreed to court order settlement of the
condemnation litigation;
2 . Engage a firm to conduct a Phase I environmental
study at a cost of $3,500;
3. Maintain housing court enforcement actions until
a court order is issued on the settlement amount .
4 . Discuss Town Square concepts with a consultant
to determine scope and cost of services.
The Village Attorney stated that if Grove Mall agrees to
the settlement, closing on the property could happen by
September 1 .
The meeting adjourned at 10:59 p.m.
