Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on July 11, 1995 this Executive Session was called to
consider a Litigation matter.

LITIGATION
The Village Attorney brought the Village Board up to date
on the status of negotiations for the condemnation of the
Grove Mall . The Village Attorney stated that the previous
settlement figure of $6. 1 million had been withdrawn due to
the fact that the Grove Mall 's attorney had negotiated without
receiving the proper authority from his clients.
The village Attorney stated that he had spoken with the
new authorized attorney and confirmed that the Village could
settle at $6. 15 million. The Village Attorney recommended
that the village approve that amount due to the fact that
Jewel had agreed to give up their lease at no cost, thereby,
saving the Village $40,000 and increasing the true cost of the
settlement by only $10,000.
The Village Attorney stated that if the Village Board
approved the settlement figure the Village would be able to
close on the property in October or November with the Village
to take over the property in January of 1996.
After further discussion, the consensus of the Village
Board was as follows:
-- to authorize the Village Attorney to negotiate a
settlement of $6. 15 for the property, not including
the Burger King;
-- to have the contract place responsibility of the
environmental study and obtaining the termination of
the leases of all stores except for the Jewel
on the Grove Mall; and
-- to authorize the Village President, Village Attorney,
and village Manager to develop a team of experienced
professionals to provide financial, technical, and
architecture consulting services in preparation for
the redevelopment of the property.
