Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on August 22, 1995 this Executive Session was called to
consider a Litigation matter.

LITIGATION - GROVE MALL
The Village Attorney stated that he had received and
reviewed the Phase I environmental study conducted by
Mostardi-Platt. The Village Attorney recommended that the
Village undertake the Phase II environmental study in order to
provide an estimated dollar amount for remediation of
underground storage tanks, unknown oil tanks (Goodyear) ,
asbestos, and chemicals related to the dry cleaning facility.
The Village Attorney stated that the Phase II study would take
approximately one month and cost about $35,000.
The Village Attorney stated that he was still negotiating
terms for the no condemnation statement with Burger King and
Citgo and that no agreement would be presented until both
companies agree to develop their facades in conjunction with
the town square concept of the redeveloped Grove Mall. The
Attorney also stated that he was continuing to work on an
agreement to allow Citgo to replace their sign at Biesterfield
and Arlington Heights Road.
The Village Attorney recommended that the village meet
with Kracower & Associates instead of Trkla to discuss
redevelopment of the Grove Mall site.
Upon further discussion, the consensus of the Village
Board was as follows:
-- to authorize the Village Attorney to conduct the Phase
II environmental study at a cost of $35,000; and
-- to schedule a date for the Village President, Village
Attorney, Village Manager and village Board members to
meet with Kracower & Associates to discuss
redevelopment concepts for the Grove Mall site.
