Lissner Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on August 22, 1995 this Executive Session was called to consider a Litigation matter. LITIGATION The Village Attorney informed the Village Board that the village had received a threat of litigation from MCI Metro over their rights to install fiber optic cable within Village rights of way. The Village Attorney explained that MCI Metro was challenging the Village 's moratorium on fiber optics and was seeking to begin construction of their facilities within 10 days of notification to village as may be allowed under Illinois case law. The Village Attorney stated that the Village 's moratorium on fiber optics would not be lifted until October when the Northwest Municipal Conference model telecommunications ordinance is passed. The Village Attorney recommended that the Village enter into a non-binding interim agreement with MIC Metro, which would allow them to install fiber optics in Northwest Point, which is their first targeted location. After that, the Village will address a franchise agreement for the remainder of the community which would be passed after the adoption of the telecommunications ordinance. The consensus of the Village Board was to authorize the Village Attorney to negotiate an interim agreement with MCI Metro to be presented to the Village Board for consideration at the September 12, 1995 Village Board meeting. The meeting adjourned at 10:30 p.m.
