Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on September 12, 1995 this Executive Session was called to
consider a Litigation matter.

LITIGATION
The Village Attorney brought the Village Board up to date
on the status of negotiations with the Grove Mall . The
Village Attorney stated that preliminary reports indicate that
the amount of asbestos removal required on the site was not as
much as originally thought . In addition, the Village Attorney
indicated that Citgo and Burger King were willing to cooperate
in the redevelopment of the facilities in conjunction with
redevelopment of the Grove Mall property with a town square
atmosphere.
The Village Attorney indicated that the new Federal
lawsuit filed against the Village on September 11 , 1995 was
filed by Lynda Khan and Judy Serfecz with only general
knowledge of their co-counsel . The Village Attorney stated
that all offers from the village to purchase the property
would be removed until the lawsuit is dismissed. In addition,
the Village Attorney stated that Ron Zamarin was preparing a
motion to defend the Village and that all costs of defense
should be subtracted from the settlement offer for the
property.
The Village Attorney requested permission to continue
working with outside parties on the redevelopment of the
property. in addition, the Village Attorney recommended that
the Village continue to pursue condemnation litigation and
maintenance violations in court.
Upon further discussion, the consensus of the Village
Board was as follows:
-- to remove all offers to purchase the property;
-- to proceed with condemnation litigation;
-- to actively enforce all housing court matters; and
-- to authorize the village Attorney to continue working
with outside parties toward the redevelopment of the
property.
The meeting adjourned at 10:20 p.m.
