Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on September 26, 1995 this Executive Session was called to
consider a Litigation matter.

LITIGATION
The Village Attorney brought the Village Board up to date
on the status of the Grove Mall condemnation litigation. The
Village Attorney stated that the Village was proceeding with
condemnation litigation. Special counsel Ryan agreed to the
Judge 's request to a two-week period before proceeding with
the trial . In addition, the Village is proceeding with all
housing court matters.
The Village Attorney estimated the timeline for a
settlement/verdict to be approximately 1 112 to 3 years at a
cost of $200,000. The next court hearing on the condemnation
suit is scheduled for Tuesday, October 10, which will allow
the Village Attorney to provide a status update of the
litigation following the October 10 Village Board meeting.
In addition, the Village Attorney stated that the
Village 's motion to dismiss and sanctions against the Grove
Mall 's lawsuit were being filed.
