Lissner Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on October 10, 1995 this Executive Session was called to consider a Litigation matter. Number of pages attached: 1 Date(s) of review for release: (� Jannuaryq 1996 Date of approval for release: /��Q -9/ 16,5 c5y 10110195 8:45 p.m. LITIGATION The Village Attorney brought the Village Board up to date on the status of the Grove Mall condemnation litigation and the Village 's defense against the lawsuit filed by Joe Serfecz. The attorney stated that R. Zamarin had filed a motion to dismiss the lawsuit against the Village with sanctions. The status of the case has been heard and will be addressed upon the selection of the judge. The Attorney stated that he is continuing to have conversations with existing tenants regarding their position upon condemnation of the property. The attorney stated that Good Year may be able to be removed due to violations of their lease. Burger King continues to express a desire to remain at their location. Walgreens has placed a value of $1 million on their lease. Our appraisal estimates its value at $150,000. The attorney stated that the initial results of the Phase II environmental study are positive with the exception of the chemical solution which has been deposited from the dry cleaning facility. The attorney recommended additional soil boring tests to assess the full extent of the damage to the property. Finally, the Village is proceeding in housing court . Serfecz is developing items for consideration by the Judge since the center is to be demolished. Upon further discussion, the consensus of the Village Board was as follows: -- have the Village Attorney continue to work with Burger King to ensure their lease language does not interfere with any proposed redevelopment; and -- to authorize the use of additional soil borings in order to assess the extent of the environmental damage to the property at a cost of $400.
