Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on April 23, 1996
Executive Session was called to consider a litigation matter.

LITIGATION
The Village Attorney brought the Village Board up to date on the status of
filing of the agreed judgment order in the Grove Mall condemnation matter. The
Village Attorney stated that Serfecz's attorney, L. Khan, had dismissed herself from
representing Serfecz and had sent a letter to the Village Board indicating that she
may take action against the Village for interfering with her client. The Village
Attorney stated that he, B. Ryan, and R. Zamarin had reviewed the matter and felt
that she had no cause of action against Elk Grove Village and recommend that the
Village proceed with filing the agreed order as previously discussed.
Upon further discussion, the consensus of the Village Board was as follows:
• authorize the Village Attorney to file the agreed judgment order;
• have the Village Attorney investigate the possibility of ethical
misconduct by L. Khan; and
• authorize the Village Manager and Village Attorney to interview
development consultants and develop a list of 2 or 3 possible
companies to be considered for the redevelopment plan.
The meeting adjourned at 7:45 p.m.
