Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on August 13, 1996
Executive Session was called to consider a litigation matter.

LITIGATION
The Village Manager and Village Attorney brought the
Village Board up to date on the status of the Grove Mall
demolition contract and timeline.
The Village Attorney stated that the initial work
provided for the Phase II environmental study by Mostardi-
Platt did not include testing of the Jewel store. The report
was done for the purchase of the property, not environmental
demolition. As a result, the total cost of abatement of the
property is likely to exceed the original estimate of
$63, 000. The Village 's agreement with Serfecz limits
Village liability to $75, 000. The Village Attorney stated
that Mostardi-Platt will complete testing of the Jewel under
the previous contract amount.
The Village Attorney explained that additional reports
would also be required to develop bid specifications for
demolition contractors. Mostardi-Platt has estimated that
this report would cost $8, 500 but did not provide a formal
offer to the Village.
Upon further discussion, the consensus of the Village
Board was as follows:
• to authorize Mostardi-Platt to complete the Phase II
report on the Jewel building at a cost of $300;
• to approve Phase III work by Mostardi-Platt subject to
Village Board approval of the final contract amount;
and
• To amend the demolition time frame to one phase during
the winter months.
The meeting adjourned at 7:45 p.m.
