Pursuant to a duly made and approved motion and a majority vote at a
regularly scheduled meeting of the Village President and Board of Trustees
on 1-9-90 this Executive Session was called to consider a
litigation matter.

LrTIGATION
Special Counsel Joseph Karaganis informed the Board of
the chances of success and the costs associated with continuing
litigation to prevent the relocation of the CBS Radio Tower to
the proposed floodway site in Roselle.
The Board was told that the probability of succeeding
through litigation is good, as are the chances of failure.
The Board discussed whether to try to negotiate a
settlement or continue litigation. No consensus was reached.
The meeting adjourned at 8:10 p.m. for discussion after
the Village Board meeting.
