Gallitano, Fran McCormick, Resident Village Trustee Tom MCEnery, Resident Bob Evans, Resident Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on 6-12-90 , this Executive Session was called to consider a Li#i ga}ioa matter. Number of pages attached: 2 Date(s) of review for release: January 1990 w / p Date of approval for release: �- S LrrrcATraP Attorney Knickerbocker provided the history leading up to Pecora's Iawsuit challenging the validity of Cook County's R-5 zoning of the property. State's Attorney Motta opined that it is highly unlikely that the R-5 County zoning will be upheld, given the trend of development in the area. it is also unlikely that Pecora would receive a straight County I-1 zoning because of the number of permitted uses that would be incompatible in the area. it is highly likely, however, that a limited I-1 zoning would be granted to permit the construction of an office/warehouse. Given this, three options exist: 1) Pecora will amend his lawsuit to have the parcel rezoned limited I-1; 2) Pecora can apply for a Cook County R-5 Special Use Permit to operate an office/warehouse facility; or 3) Pecora and Elk Grove Village can negotiate an annexation and limit traffic noise and hours of operations in the agreement.
