Karaganis, special Counsel - Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on 2-26-91 this Executive Session was called to consider a litigation matter. Number of pages attached: `Y Date(S) of review for release: July 1991 Date of approval for release: LITIGATION Attorney Karaganis brought the Village Board up-to-date on the litigation surrounding the relocation of the WBBM radio tower. Karaganis noted that three permits are needed to build on the site: 1) FCC permit. Has not been issued; 2) IDOT permit. Recently issued. Village can file a complaint in Cook County Circuit Court based on IDOT's not following procedural requirements and not using correct flood data. 3) U.S. Army Corps of Engineers Permit. Previously issued. Village filed a suit in Federal Court. Karaganis is waiting for a ruling on our motion for summary judgment and a ruling on CBS and Hamilton Partners motion to intervene. It was the consensus of the Village Board to file a complaint against the Illinois Department of Transportation, Division of Water Resources, for issuing a permit to build in a floodway. The complaint is to be filed by Karaganis in the Cook County Circuit Court.
