Pursuant to a duly made and approved motion and a majority vote at a
regularly scheduled meeting of the Village President and Board of Trustees
on 5-21-91 this Executive Session was called to consider a
Iitigataon matter.

LITIGATION
Attorney Karaganis brought the Village Board up-to-date
on the litigation surrounding the relocation of the WBBM radio
tower.
The Village has two suits pending:
One suit is against the Army Corps of Engineers for issuing
a permit for construction in a floodplain in violation of an
executive order; and,
The second suit is against the Illinois Department of
Transportation, Division of Water Resources, for issuing a permit
to allow a radio tower to be constructed in a floodway, although
a radio tower is not an appropriate use in a floodway.
To dispose of the cases on motions will cost an additional
$30,000 to $40,000.
The consensus of the Committee was to pursue the litigation.
The meeting was adjourned at 9:30 p.m.
