Tosto, Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on _ December 8, 1992 this Executive Session was called to consider a litigation matter. i pnn Number of pages attached: Date(s) of review for release: January 19 Date of approval for release: 12/8/92 - 6:39 p.m. LITIGATION The Village Attorney provided a status report regarding the Tierney (Biesterfield Road) lawsuit. The case was brought before the Judge today, who continued it for the fifth consecutive time. The Village of Schaumburg has a motion for dismissal that was originally scheduled to be heard June 11 . The case was continued to July 22, September 9, October 30, December 8, and now January 20, 1993. The Village is a named party to the lawsuit but does not appear to have properly been served. The Village Attorney advised the Board that the pleadings are not present in the Judge 's court file. They must be present for the Village to be properly served. The Village Attorney will continue to investigate whether the Village was properly served with the amended complaint as alleged by the complainant. The meeting adjourned at: 6:50 p.m.
