Pursuant to a duly made and approved motion and a majority vote at a
regularly scheduled meeting of the village President and Board of Trustees
on December 15, 1992 this Executive Session was called to consider a
litigation matter.

WBBM Radio Tower Litigation
The Village President reported that the Village won a
favorable decision in the 7t:h Circuit Federal Court of Appeals
last week.
The Federal Appellate Court ruled that the lower court, which
upheld the U.S. Army Corps ' issuance of a permit to build in a
floodway despite a Presidential Executive Order, had no
Jurisdiction in the case. 7°he Appellate Court remanded the case
back to the lower court and ruled that they will not have
Jurisdiction until the Federal Communications Commission (FCC)
issues a permit.
Special Counsel Karraganis will be meeting with the Board in
the future to discuss the Village 's litigation efforts in more
depth.
