Pursuant to a duly made and approved motion and a majority vote at a
regularly scheduled meeting of the Village President and Board of Trustees
on February 23, 1993 , this Executive Session was called to consider a
Litigation matter.

LITIGATION
The Village Attorney reported that the attorney who filed the
Tierney litigation is seeking a default judgement against the
Village for not replying to the Tierney lawsuit. The lawsuit was
dismissed against the Village of Schaumburg which was a
co-defendant in the case.
The Village Attorney noted that the motion for default
judgement is weak as the Village was never served properly.
State Statues require the Village Clerk to be served. In this
case, the Village Clerk was never served. A hearing has been set
for May on the Village's motion to dismiss the case.
