Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on July 13, 1993, this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village President noted that the Village may have to
litigate against the developer of Park Chardonnay due to some
building problems that exist on the site. The Village President
also noted that in the future we should consider requiring a 10%
performance bond for private improvements.
The Village Manager added that staff is currently withholding
temporary certificates of occupancy from the developer until the
problems are solved. The Village Manager noted that it is also
possible to withhold real estate transfer tax stamps. However,
in doing so the Village Attorney noted that the developer may
litigate against the Village.
The consensus of the Board was to permit staff the ability to
withhold real estate transfer tax stamps from the developer in
order to obtain commitments from the developer to correct
outstanding problems at the development since the developer has
been unresponsive to Village requests.
