Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of ,
Trustees on July 27, 1993, this Executive Session was called to
consider a litigation matter.

LITIGATION
The Village Manager noted that a majority of the data
received from the residents of the Park Chardonnay complex was
not warranted and only consisted of some workmanship items.
Furthermore, there are no building code violations on the site.
The biggest concern is the grading plan which still needs
approval by the Village. Total grading work will cost an
estimated $25,000 to perform.
Staff is currently negotiating with the developer to resolve
the issue. It was noted that the Village is exercising the
ability to withhold real estate transfer stamps from the
developer with the knowledge that the developer may litigate
against the village and attempt to obtain damages.
