Pursuant to a duly made and approved motion and a majority vote at
a regularly scheduled meeting of the Village President and Board of
Trustees on November 16, 1993, this Executive Session was called to
consider a litigation matter.

Litigation
The Village President reported that he received a fax from
Jim Tofilon who resides at 1880 Maine Drive. The fax indicated
Tofilon will be filing a class action lawsuit against the Village
on November 18, unless certain conditions are met because the
Village allowed his home to be constructed in a flood plain .
Tofilon is distributing information to neighbors in an attempt to
solicit funds to file the lawsuit .
The Village Manager noted that homes in Stockbridge and West
Gate were not built in a flood plain. The developer, Centex
Homes, completely regraded the area, placing the flood plain upon
what is now the Fox Run Golf Course.
The Director of Engineering and Community Development
indicated that the Village has been working with the Federal
Emergency Management Agency (FEMA) to have the Flood Plain maps
changed to reflect the actual floodplain since 1979 . FEMA has
requested that the Village submit the same information on three
different occasions but they have not acted on that information
for the past 8 years.
The consensusofthe Committee was to: 1 ) write to a
Congressional Representative (Hyde and/or Crane) seeking
assistance to find an upper level person in FEMA that can resolve
the situation; 2) write a letter to Tofilon setting forth the
facts; and 3) write a letter to Tofilon 's neighbors setting forth
the facts.
