Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on January 28, 2003 this
Executive Session was called to consider a Litigation matter.

Litigation
The Mayor stated that he authorized the Village Attorney to begin settlement negotiations
on the Fire&Police Commission litigation. The Mayor noted the Board's stance on not
settling such suits, but he made the decision in order to minimize the significant personal
liability of the Commissioners and the Fire Chief.
The Village Attorney stated the Fire Union representatives will seek changes to the
Lieutenant promotion testing, and he will keep the Board updated as the issue proceeds.
