Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled
meeting of the Village President and Board of Trustees on April 8,2003 this Executive Session
was called to consider a Litigation matter.

Litigation
Involuntary Annexation Lawsuits
The Mayor reported that there are 7 areas of unincorporated pockets in the Village and that
the Village needs to consider involuntarily annexing. The annexation proceedings on the
Branigar Estates subdivision and Itasca Meadows Farm subdivision will bring legal
challenges, and the Village needs to be prepared to defend these challenges if annexation is to
be pursued.
The consensus of the Committee was to review each parcel in detail. Items for consideration
include:
■ Cost to install public improvements by the Village and costs on the homeowner to
recapture those costs through a special assessment;
• An analysis of the property tax costs versus benefits of the unincorporated property
annexing to the Village;
• The benefits to the Village of annexation;
• Which Village Code requirements should be imposed immediately versus later; and,
• What loss in revenue might the Village experience through reduced Water and Sewer
fees?
