Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled
meeting of the Village President and Board of Trustees on May 27,2003 this Executive Session was
called to consider a Liti ag tion matter.

Litigation
The Mayor noted that tonight's Board meeting agenda includes the use of$500,000 for O'Hare
litigation purposes. The funds will be from the General Fund, O'Hare Advocacy account in the
Legal Activity. In addition, another$500,000 will be utilized from the ICRC to replenish the first
draw down for the Trust fund,which was established by using a portion of the 4-month reserves.
The Village of Bensenville is likely to approve an addition of$3.6 million for this purpose.
