Pursuant to a duly made and approved motion and a majority vote at a regularly
scheduled meeting of the Village President and Board of Trustees on June 17 ,2003 this
Executive Session was called to consider a litigation matter.

Litigation
Mayor Johnson discussed a recent meeting he had with Ted Pecora regarding Pecora's 5-
acre unincorporated parcel on Higgins Road. Ted Pecora has filed a lawsuit against Cook
County to gain approval of a plan to construct storage units on the property. This
property abuts an existing residential neighborhood in Elk Grove Village, making the
storage unit proposal undesirable. Mayor Johnson reported that he suggested the
construction of townhomes on the property as an alternative plan. As an incentive to
consider this alternative, the Board discussed the possibility to offer a waiver of the
Village's 10% land or cash donation applied to residential annexations. The consensus of
the Board was to authorize the Mayor to present this offer if Ted Pecora withdraws his
lawsuit and agrees to pursue a townhouse development on the property.
