PROCHNO Village Trustee Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting of the Village President and Board of Trustees on Anril 13,2004 this Executive Session was called to consider a Litigation matter. Number of pages attached: 1 Date(s) of review for release: December 2004 Date of approval for release: c5 "/�O/ , 077 — 09- 4/13104 7:37 p.m. Litigation The Village Attorney noted that the Village is in the final stages of an Appellate Court briefing regarding the trial court's denial of the Village's disannexation fee. In addition, it was noted that our Federal Court litigation, regarding the City of Chicago's use of Environmental Impact Study funds for the development of their O'Hare Modernization Master Plan, is going extremely well. Most agencies receive no more than$35 million to conduct their EIS,but the City of Chicago has collected$250 million in EIS funds. It is illegal to use these funds for anything but the EIS. If we prevail, Chicago will likely lose one of its funding mechanisms for the development of its O'Hare Modernization Master Plan. The meeting adjourned at 7:38p.m.
