Mullen, Chairman Legislative Planning & Zoding Committee RE: New zoning statute prepared by Illinois State Bar Association The Committee has carefully reviewed the proposed legislation to re- vise the Illinois Municipal Zoning Enabling Act, and the specific points raised by the Illinois Municipal League in their letter which was referred to us on February 1, 1966. We offer the following comments on the specific items as listed. Section A 9. The Committee feels that due to our excellence in maintain- ing adequate records in all zoning proceedings any require- ment that we duplicate this service by recording each and every zoning ordinance amendments with the County Recorder of Deeds would unnecessarily burden not only the administra. tive staff of Elk Grove Village but also the Office of the Cook County Recorder of Deeds. We recommend that the require- ment to record all zoning ordinance amendments with the County Recorder of Deeds be ommitted. 10. The Committee feels that since the ultimate responsibility for proper zoning rests with the corporate authorities, the option to vest all final decisions in zoning matters to the corporate authorities should remain. It is the feeling of this Committee that a zoning board of appeals should have a majority of the members of that board in attendance at every public hearing. We recommend that the provision, permitting a public hearing before one member of a board of zoning appeals be excluded. Section C It is the feeling of this Committee that anyone seeking relief from a zoning ordinance or from the decision of a municipal official should not be required to obtain the services of an attorney. We recommend that any requirements as to form or wording of an appeal, be made simple enough for the average layman to prepare and present. President Pahl will present the views contained therein and h s own veiws at a meeting which he and Attorney Hofert will attend on this matter. The report referred to above will be on file in the Clerk's. office- - /4rustee Mullen as Chairman of the Judiciary Committee, reported that Trustee Lewis has sent a questionnaire to other communities regarding sign, inspection, tap-in and other service fees. Replies have been received, some of which require clarification and have been returned. A preliminary examination indicates that in some cases the Village fees are the same or below those of other dommunities.
