Committee meeting, as called by Chairman Petri at the regular Village Board Meeting of January 12, 1982, convened at 7:08 P.M. , Wednesday, January 20, 1982, in the Trustees Conference Room of the Municipal Building, 901 Wellington Avenue. Members Present: Petri, James, Chairman Bosslet, Joseph Hauser, Edward Members Absent: none Staff Present: Engelbrecht, Fred, )Chie£ of Police Henrici, Charles, Fire Chief Knickerbocker, George, Village Attorney Rettenbacker, Thomas, Building Commissioner Sunagel, James, Deputy Fire Chief Alarm Ordinance Proposed ordnance .drafted by village attorney and statistical data from police department was reviewed by Committee. Discussion ensued as to advisability of having such an ordinance and its intent (to reduce the nuTber of false alarms) . Fire department staff present indicated their inclusion in the ordinance was not necessary at this time, except that portion which pertains to automatic dialer prohibition. Further dis- cussion relative to mechanics of licensing, enforcement, and penalty provisions followed; these aspects will be administered jointy by police department and Clerk's Office. The Committee unanimously recommended passage of the ordinance after certain specifics were addressed and responded to by staff or the village attorney. Village attorney rec- omcrended public hearing be held and communication advising of proposed ordinance be forwarded to Greater O'Hare Association for their infor- mation. In the interim, draft of proposed ordinance will be disseminated to President and Board of Trustees. The tentative date mentioned for public hearing was February 23, 1982 at 7:00 P.M. Lotteries & Raffles Mr. Hauser called the Committee's attention to several newspaper articles which cited the opinion of the Attorney General's Office and postal regulations in regard to lotteries. Federal law prohibts use of mail to deliver lottery tickets or related material. The State Raffle Act passed last year permits county or municipal governing bodies to license raffles by certain non profit organization or prohibit raffles altogether if they so desire. In that the proceeds of the raffle in question would not go totally to a non profit organization the Committee will recommend no action be taken on this matter, it be taken off their agenda, and a report nude to the President and Board of Trustees. Retail Sales Space Variation - 1400 Higgins Mr. Bosslet questioned utilization of space as portrayed by the petitioner after having visited the site. Mr. Hauser expressed concern that the petitioner had proceeded outside Zoning Ordinance provisions. The Committee further expressed concern that granting of variation, although recommended by Zoning Board of Appeals, might tend to erode integrity of industrial zoning. The village attorney provided several available options to resolve this matter and after considerable discussion with building commissioner the Committee decided to reconvend variation be granted on a temporary, conditional, limited, restricted basis with the petitioner being so advised and required to appear before Plan Com- _mission to request B3 zoning. Zoning Ordinance Restriction Concerning Retail Use In Industrial Park. Concern was expressed by Committee that allotting additional retail space in Industrial Park would/could, in effect, dilute or defeat present Zoning Ordinance; square footage of buildings and usage has to be given further consideration. The Committee recommends that the petitioner, Mr. Klyber of Greater O'Hare Association, and others if they so desire, appear before them to present further evidence and testimony as to need for additional retail space. Mr. Bosslet requested the building commissioner provide the Committee with the number and identity of those ca,panies currently possessing retail sales licenses. (On January 12, 1982, the Village Board authorized the purchase of Police vehicles through the State of Illinois' annual purchase contract procedures.) F. The Board award a purchase contract in an amount not to exceed $20,000.00 to Layne-Western Company, Aurora, to pull , inspect and replace the cable and submersible motor at Well No. 4 (901 Chase Avenue) . Recent severe weather conditions may have caused electrical malfunctions in the cable and/or motor at Well No. 4. As a result, the well has been out of service since January 11 , 1982. The President directed the Clerk to call the roll on the motion to adopt the Consent Agenda, Items A through F, and upon the roll being called the following answered AYE: Trustees Hauser, Petri , Uhlarik, Bosslet, Chernick; NAY: none; ABSENT: Trustee Tosto; whereupon the President declared the motion carried. Trustee Petri , Chairman of the Judiciary, Planning and Zoning Committee, reported that the Committee met on January 20, 1982 and as a result of that meeting has scheduled a meeting with the Board for Tuesday, February 9, 1982, 7:00 p.m. , to discuss the proposed (Police) Alarm Ordinance. The Clerk was directed to send a letter and the proposed Alarm Ordinance to Stan Klyber of the Greater O'Hare Association, and to the companies that install alarm systems in the Village informing them of the February 9th meeting which they are welcome to attend and be heard. Trustee Petri stated the Committee feels that it would not be in the best ---'' interest of the Village to allow Lotteries/Raffles in the Village at this time and requested this item be removed from the. J.P Z. Committee Agenda. Trustee Petri also stated the Committee recommends directing the Village Attorney to prepare an ordinance for a variation of the five (5%) percent retail sales requirement of the Zoning Ordinance for property located at 1400 E. Higgins Road subject to the following restrictions: 1 . Space allocated for the showroom and sales of new or used furniture be limited to thirty-one (31$) percent of the square footage of the leased premises. 2. That the location of said thirty-one (31%) percent be depicted on a floor plan and attached to the ordinance. 3• That the variation be for a one (1) year period and in that time frame the owner is directed to approach .the Plan Commission for a Public Hearing requesting B-3 Zoning. - 2 - 1-26-82
