Members Present: James Petri Edward Hauser Joseph Bosslet Staff Present: George Knickerbocker Robin Weaver Tom Rettenbacher Others Present: David Zajicek, attorney for Manor Healthcare Geoffrey Gilbert , for Manor Healthcare Greco De-annexation Petition The matter of the Greco de-annexation petition was discussed. The history of the property and legal issues were examined. The Village Attorney stated that an annexation can not be challenged after one year except under contractual obligations. Such obligations don' t exist as the property was annexed by ordinance without a preannexation agreement. The plat of annexation was recorded on November 6, 1986. The Committee' s unanimous decision was to: 1) recommend denial of de-annexation; and 2) recommend approval of the Special Use Permit for a Nursing Home conditioned upon a two-year period and payment of the 10% of purchase price of the property. Staff was directed to contact the attorney for the Grecos and Guzzos with the information that a negative recommendation would be made at the March 22, 1988 Village Board meeting. Public Passenger Vehicle Concept Members briefly discussed the Public Passenger Vehicle Concept and requested that the Village Attorney provide a review/recommendation. Devon Avenue Corridor Devon Avenue between Carlisle Avenue and Tonne Road) The Village Attorney presented materials regarding the proposed text amendment, change to the Comprehensive Plan and rezoning of property. Members were in agreement with the proposal and directed that the required public hearings before the Plan Commission proceed on April 6, 1988. Happy Hour Letters from area communities and possible ordinances were reviewed regarding restrictions on "happy hours" and "two for one" Minutes JPZ Committee March 14, 1988 -2- drink specials. While members endorsed the concept, it was pointed out that there were many ways to circumvent the restrictions. Adjournment 9: 10 P.M.
