The proposed ordinance is actually an addendum to the Housing Maintenance and Occupancy Code, which has been used for single and multi-family dwellings for over a decade. Additional items in the proposed rental code include: licensing and fees; expansion of how violations are communicated; penalties; expanded section of repairs; a more detailed section and a section on board ups. JPZ Committee discussed the possibility of adding it to the current Housing Maintenance Code. Mt. Prospect currently licenses and charges fees for multi-family dwellings. They have been taken to court and have lost the case. Before this proposed ordinance is taken any further, JPZ decided to get a legal opinion from the Village attorney. A copy of the pro- posed ordinance and the Mt. Prospects legal decision will be sent to Mr. Knickerbocker. Proposed Tanning Booth Ordinance The JPZ Committee discussed the possibility of adopting a Tanning Booth Ordinance. They were waiting for an ordinance to be prepared by the National Radiological Health Organization. Jim Kreager, of the FDA Radiological Health Division, suggested that we look at the ordin- ance adopted by Montgomery County, Maryland. This ordinance will be reviewed by the Elk Grove Village Board of Health, and if approved, will be forwarded to JPZ Committee for approval. Page 2 - Minutes of Judiciary, Planning & Zoning Committee Proposed Commercial Maintenance Code JPZ would like to consider adopting a commercial maintenance code. BOCA came out with one in 1984. The committee would like Tom Rettenbacher to give his thoughts and recommendations to JPZ on adopting this code for the Village.
