HomeMy WebLinkAboutJPZ - 08/11/1988 - RENTAL ORD/COMMERCIAL MAINT CODE Minutes Judiciary, Planning and Zoning Committee August 11, 1988 7:00 p.m. Members present: James Petri Joseph Bosslet Members absent: Ed Hauser Staff present: Nancy Yiannias Tom Rettenbacher Others present: Duane Wong, Daily Herald Proposed Rental Ordinance Final Draft Review One change was suggested on page 3 (j) - line 5 - should read "within 5 working days" instead of "within twenty four hours." Licensing fees for rentals must be established. The Health Department will survey surrounding villages (Schaumburg, Mt. Prospect, Oak Park, Evanston, and Niles) to get their fee schedules. The Committee would like George Knickerbocker to review the Mt. Prospect court case concerning their rental ordinance to see if our proposed ordinance would hold up in a court of law. They would like this opinion before the August 23rd Village Board meeting. These items will be gathered and discussed at the next JPZ meeting. Other items discussed were: whether rented condominiums should be inspected; should common areas in condo complexes be inspected; methods used to obtain lists of rental homes and condos and what percentages of apartments should be inspected annually. Proposed Commercial Maintenance Code Tom Rettenbacher suggested that the JPZ Committee use the "1987 Existing Structures Code," written by BOCA, as the Village document for inspecting commercial and industrial facilities. The Code in- cludes residential homes but since the current housing code is based on the American Public Health Association Code, residential buildings should not be inspected under the BOCA code. JPZ asked Mr. Rettenbacher to get a package together by the August 23rd Village Board meeting that would state his suggestion. This package would include the BOCA code and an addendum that would include his recommendations. The Committee would like the Village attorney to give his opinion on an ordinance requiring shopping centers to pick up litter on walkways and roadways beyond their property lines which collect as a result of littering in the shopping centers.
