PERFORMANCE STANDARDS
The Committee began review of the remaining issues assoc-
iated with the Zoning Text Amendment incorporating new performance
standards.
The first issue related to whether enforcement of the Ord-
inance would be on a retroactive basis. The Committee agreed that
the Ordinance would not be retroactive, provided, however, that
enforcement would proceed on a complaint basis for all performance
standards with the exception of toxic substances. Toxic substance
enforcement would proceed as a function of ongoing inspections
performed by the Fire Department in the industrial district. Since
the Ordinance will not be enforced retroactively, the Committee
determined that no public meeting would be necessary.
The Committee reviewed the uses currently prohibited in
the I-1 district and recommended that they continue to be prohibited
in the I-1 district in the Text Amendment. Staff was directed to
include those prohibited uses in the Text Amendment. Staff was

to revise the Standard Industrial Classification categories in
accordance with the 1987 manual.
The Committee recommended that the Special Uses identified
in Section 5.82A of the Text Amendment be applicable only in the I-
2 Zoning District.
The Assistant village Manager suggested that those industrial
firms most likely to be impacted by the toxic substance limit be
identified and talked with to determine the impact of the restrictions.
The Fire Department indicated that maybe fifty firms will be impacted

but to what extent is unknown. Trustee Gallitano suggested that in
the future overall quantity limits could be adjusted up and/or down
if the proposed threshold cannot support industries currently operating
safely and the industry standard requires increased an/or reduced
quantities.
The Committee recommended that a fee structure be established
which would cover all costs associated with the processing and review
(including any specialists needed) of all Special Use permit requests.
The Committee reviewed the memos submitted by the Village
Attorney, Director of Engineering and Fire Department directing staff
to incorporate changes to the Zoning Amendment as necessary. Several
changes included modifying permitted outdoor storage in the I-1
district similar to what is currently allowed and adding Village
approved construction noise between 7:00 p.m. and 7:00 a.m. as an
exemption.
The Committee directed the Village Attorney to revise the
Text Amendment per the discussion and resubmit same through the Village
Manager's office.

Staff will prepare a memo for the JPZ Committee requesting
Village Board review of the official Map posted in the Trustees' Con-
ference Room.
