CHANGE IN IN-HOME DAY CARE ORDINANCE INCREASE FROM 8 to 12 CHILDREN
The JPZ Committee discussed the change in the Department of
Children and Family Services Regulations regarding the issuance of
special licenses increasing the number of children who can be
watched in a home from 8 to 12. The four extra children must be of
school age and can only be there before and after school .
(DCFS Section 406.13-C)
Village code states that no more than 8 children may be
watched in a home at any one time. The committee felt there was a
need for this additional care in the community, particularly where
there are children from the same family that went to the same in-
home caregiver.
The consensus of the Committee was to recommend that the
Village Board adopt the ordinance as distributed to them on October
5, 1993 (38A-2-1) .
The zoning ordinance currently states that no more than 8
children are allowed in In-Home Day Care Homes. The committee
decided to forgo a zoning change until such time (March 1994) that
the Department of Children and Family Services makes the special
" twelve children " license a permanent part of their regulations.

ORDINANCE NO.
AN ORDINANCE AMENDING TITLE 3, CHAPTER 8, ARTICLE A, DAY CARE
CENTERS AND HOMES, OF.THE MUNICIPAL CODE OF THE VILLAGE OF ELK
GROVE VILLAGE AS IT PERTAINS TO MAXIMUM NUMBER AND AGE OF
CHILDREN IN DAY CARE HOMES
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, State of Illinois as follows:
Section 1. That Section 3-8A-2-1 of Title 3, Chapter 8, Article
A, of the Municipal Code of the Village of Elk Grove Village be and the
same is hereby amended to read as follows:
DEFINITION: "Day care homes" mean family homes which
receive more than three (3) up to a maximum of twelve (12)
children (if they are in compliance with Section 406.13 of
the DCFS licensing standards and regulations) for less than
twenty-four (24) hours per day. The maximum of twelve (12)
children includes the family's natural or adopted children
and all other persons under the age of 12. The term does not
include facilities which receive only children from single
households.
Section 2. That this Ordinance shall be in full force and effect from
and after its passage and approval according to law.
