Niehaus, Administrative Assistant A. Boffice, Director of Engr/Comm. Dev. Regulation of Towers/Antennas Chairperson Czarnik called the meeting to order at 7:05 p.m. and asked that Alan Boffice summarize his memo of February 14, 1995 pertaining to the regulation of towers within the village. Boffice stated that the literature on tower regulation which had been provided to the village was primarily focused on the sharing of tower space by different communications media (Tv, radio, etc) . However, the village's primary concern at this point was over the proliferation of cellular antennas. Boffice stated that at this time the sharing of cellular towers may or may not be a feasible solution. Commissioner Geinosky stated that the Plan Commission was concerned over the placement of towers in residential areas. Commissioner Geinosky stated that their primary concern was that towers may be potential health hazard and a detriment to the aesthetics of the community. Commissioner Geinosky stated that he felt that towers should be regulated in regards to site location. Chairperson Czarnik requested that the JPZ Committee and Plan Commission look at possible solutions including sharing of sites, regulation through ordinance, and site marketing. Discussion of Chairperson Czarnik's request included the following: - an ordinance to direct cellular companies to potential tower sites; - an ordinance requiring companies to share space on newly constructed towers through a letter of intent; and - to have the JPZ/Plan Commission identify common sites/areas that they would approve for tower con- struction. Commissioner Henrici stated that he would prefer that the Village held a group discussion with local cellular companies which would allow the JPZ/Plan Commission to become more knowledgeable of the cellular communications industry, identify their needs, and ascertain the feasibility of sharing towers in the Village. Commissioner Henrici stated that a consultant/expert on cellular communications be present at this meeting. After further discussion, the consensus of the Committee was as follows: - have staff identify cellular companies which should be invited to a group discussion meeting regarding tower locations in the Village; - arrange to have a cellular consultant at the meeting in addition to staff (including Greg Riddle) ; and maintain the moratorium on tower requests until other- wise indicated. Currently, the village only regulates towers through height limitations in our Zoning Ordinance (35 ft. residential/60 ft. industrial) . Anyone wishing to place a structure taller than the maximum allowable height must obtain a Special Use Permit. To date, no companies have constructed towers in excess of the allowable height, however, they have placed antennas on top of existing structures which also requires a Special Use Permit. In addition, the Plan Commission has recommended approval of towers for both Ameritech and GTE Airfone, however, Ameritech still needs approval from the Village Board and GTE Airfone still needs approval from the Zoning Board of Appeals and the village Board before they can begin construction. Possible methods of regulation which have been discussed include an ordinance specifically stating which sites are acceptable for tower location; an ordinance requiring companies to share space on newly constructed towers through letters of intent; and to have cellular companies place antennas on existing structures which provide sufficient height. Prior to pursuing any of these alternatives the JPZ Committee recommends that the village contact interested cellular companies to be invited to a group discussion. This discussion will allow the JPZ/Plan commission to gain more knowledge of the cellular communications industry, identify their needs, and ascertain the feasibility of sharing towers in the Village. The JPZ Committee also recommends that the services of a consultant/expert in cellular communications be present in addition to staff in order to facilitate the discussion. After this meeting, the village will be able to address the issue of regulating towers in a more practical manner whether through ordinance or other means. In addition, future meetings may be held with businesses that own tall buildings (i.e. ABMC, Sheraton, Hampton Inn, etc) to find out if they would be willing to allow antennas to be placed on their property.
