Ostrander, Illinois Masonry Institute Promotion Trust Electro Painters Variance Request Chief MacArthur provided a brief summary of what occurred since the last Judiciary, Planning and Zoning Committee meeting on November 15. MacArthur stated that Electro Painters has had conversations with the Fire Department but has still not submitted an acceptable fire prevention plan for the spray operations in their facility. Chairperson Rettberg reiterated his concern over this issue and stated that if no acceptable plan was received prior to the December 12, 1995 Village Board meeting the Judiciary, Planning and Zoning Committee recommendation would remain "Do Not Grant". BBQ Grills at Multi-Family Dwellings Chief MacArthur reviewed his memo dated November 2, 1995 regarding potential options for regulating the use of BBQ grills at multi-family dwellings. The options included in the memo and discussed by the Committee included: (1) passage of an ordinance prohibiting "unreasonable, improper, or unattended" use of BBQ grills, (2) restriction of all recreational fires on or near balconies of multi-family buildings; and (3) regulation of owners/management agencies of multi-family dwellings requiring them to control the use of BBQ grills at their respective facilities. Considerable discussion took place regarding all the options presented by the Fire Chief. It was stated that it would be very difficult to restrict the use of BBQ grills in certain locations because this would be unfair to the majority of residents who use their grills properly. in addition, this would also be very difficult to police/enforce. It was also felt that requiring owners/management agencies to regulate BBQ grills would be ineffective due to the fact that most multi-family leases already contain restrictions on BBQ grills which are not enforced. Chairperson Rettberg questioned what recourse the Village had for enforcing the misuse of "recreational" fires as defined by the Fire Prevention Code. Chief MacArthur stated that, as written, the Village had very little ability to enforce misuse of BBQ grills because the language regarding recreational fires was very broad and open for interpretation. Chief MacArthur recommended amending the Fire Prevention Code to provide a more detailed definition of recreational fires which could be more readily enforced by the Police and Fire Departments. Assistant Chief Lackman stated that this language could possibly be supplemented with additional requirements for heat monitoring devices and fireproof materials at multi-family units. However, before passing such an ordinance he recommended that the Fire Department research existing information on multi-family units in the Village to see what the fire prevention measures they currently have and how such an ordinance may impact them. Upon further discussion, the consensus of the Judiciary, Planning and Zoning Committee was as follows: - to have the Fire chief work with the Village Attorney to draft an ordinance which would amend the definition of recreational fire to prohibit it from being unattended, uncontrolled, or being public nuisance; and - to have the Fire Department perform research on all multi-family dwellings in the Village to find out what there current fire safety standards are and how additional requirements might affect them. Victoria Banquets Text Amendment Administrative Assistant Scott Niehaus summarized his memo of November 10, 1995. Niehaus stated that Village staff had contacted neighboring communitiesthought to have horse stables to find out there approach to the proper and safe stabling of horses. Communities .contacted included Long Grove, Wheaton, Arlington Heights, and Schaumburg. However, none of these communities had specific provisions for the stabling of horses. Trustee Petri stated that the City of Chicago might have some specific language pertaining to the stabling of horses. Niehaus stated that he would contact Chicago to obtain their information. In lieu of this, the Village Attorney has drafted language which addresses the main concerns expressed by the Village Board which were (1) proliferation of horse stables throughout the Village and (2) welfare of the animals. This was accomplished by classifying horse stables as an accessory use to banquet facilities in Office Park Districts and by requiring an occupancy permit from the Health Department for the facility to be used. By requiring a permit, the Village will have the opportunity to inspect the stable for health, safety and sanitary measures prior to horses being located there. In addition, the Health Department and Fire Departments would perform regular inspections on the facility. The Committee expressed additional concerns regarding the size of the facility and what type of security would be provided. Niehaus stated that the size of the facility could be limited by placing a cap on the number of horses permitted. In addition, he stated that he would contact the petitioner to find out what security measures they had planned to protect the horses from tampering by other individuals and/or getting loose. Upon further discussion the consensus of the Judiciary, Planning and Zoning Committee was as follows: - have the Village Attorney revise the text amendment to limit the number of horses permitted in the stable to four(4) and to specify horses as the only allowable animal; and - to have staff contact the petitioner to find out what security measures would be implemented to protect the safety of the horses.
