Knickerbocker, Village Attorney NON GO VERAMEMLSIGNSINPURL ICRIGHT-0EWAY The JPZ Committee reviewed a staff report concerning the ability to permit nongovernmental signs in the public right-of-way. The Village Attorney noted that the current legislation does not allow any private signs including garage sale signs, realty signs, or political signs in the public right-of-way. The Assistant Village Manager noted that the current prohibition is well understood throughout the community. The Village has invested a considerable effort in educating the community about where signs can and cannot be placed and the Village's enforcement efforts have been geared toward educating the community. The current legislation may cause an inconvenience, but those needing to advertise garage sales and open houses have been able to do so. Chairman Lissner noted a conversation he had with the owner of a local realty office. The current ordinance has had a minimal impact upon their ability to market homes. In fact,the ordinance has assisted the office in that Realtors utilize the need to ask residents for permission to post a sign on private property as a positive contact for the possible future sale of that real estate. The Committee noted the following concerns about amending the current ordinance: • The current ordinance is well understood throughout the community. Any change to the ordinance will result in extensive staff time in educating the community as to the new rules and regulations. In addition, other signs such as house painting advertisements, summer help advertisements, etc will be posted on weekends and remain posted throughout the week requiring extensive enforcement efforts. The amount of staff time to enforce the current ordinance is minimal. • The community looks clean and orderly without signs in rights-of-way. Allowing signs in the parkways on weekends will have the community looking sloppy. Residents and others posting signs will not take them down and signs will proliferate on utility poles. • Since the current ordinance was approved by a Judge during the settlement of a lawsuit, amending the ordinance could potentially expose the community to a legal challenge. At a minimum, the Village cannot discriminate between sign types. If any private sign is allowed in the right-of-way, they must all be allowed in the right-of-way. Upon further deliberation, it was the unanimous consensus of the JPZ Committee members to recommend against any modification to the current legislation. Chairman Lissner will issue a report to the Village Board detailing the recommendation of the Committee. POSSIBLE ANNEXATIONS The Committee reviewed a staff report concerning the annexation of property to the Village. It was noted that some of properties originally designated by the JPZ Committee for review have been annexed or have an annexation petition on file with the Village. Those areas include: Walsheim Property (annexed for senior housing); the property to the north(Mary Crest homes has petitioned to annex the property for the development of a mixed use townhome/commercial development); and, the property on Nerge at Plum Grove Road (Americana recently submitted a petition to annex the property). The Committee discussed the possibility of annexing unincorporated residential homes on Cosman and Home Avenue since these homeowners benefit from municipal services without paying for them. The homeowners on Cosman were contacted by the Village and they do not want to voluntary annex to the community. The Consensus of the JPZ Committee was to not recommend any Village Board action at this time. The Committee will plan to meet each spring to discuss the possible annexation of remaining unincorporated properties. c: President and Board of Trustees, Village Manager, Assistant Village Manager, Assistant to the Village Manager,Village Attorney, Village Clerk, Director of Engineering and Community Development.
